Welcome. At Boardwalk Pictures, Inc. (“BPI” or “Company”, “we”, “us”, “our”), we respect your privacy and want to protect your personal information. BPI shall mean collectively Boardwalk Pictures, Inc. and its affiliates, any related entities, individuals, and subsidiaries, and any of their trustees, directors, officers, shareholders, members, employees, representatives, consultants, attorneys, agents, suppliers, distributors, licensees and/or licensors (“Affiliates.”).
BPI owns, operates, and maintains a website at www.boardwalkpics.com and also at www.cricketlanepost.com (collectively our “Websites”) and all of the various pages contained therein, including their subdomains, and all portals, applications, services, events, and any interactive features, applications, or other services that post text or a link on our Websites (the “Sites”).
This Privacy Policy describes the types of information we handle when you visit or use our Sites and sets out our practices for collecting, using, maintaining, protecting, and disclosing that information.). By using our Sites, contacting us to inquire about our Business Services, visiting our Location, and/or providing us with personal information (as defined below) via any method or means you choose to rely upon, you consent to the practices set forth in our Privacy Policy which is incorporated by reference into our Terms of Use, which together govern your use of the Sites and/or our Business Services.
Please be advised that we do not collect any personal information from you when you visit or use our Sites. Our Websites (the “Sites”) collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, and/or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device (“personal information”).
The table below also lists, for each category, our expected retention period and use purposes. We do not sell the information or share it with third parties for cross-context behavioral advertising.

Any reference to Business Services herein refers to the creation and production of unscripted, non-fiction, character-driven entertainment for television and feature films.
Our Information Services obtain the categories of personal information listed below from the following categories of sources:
- Directly from you. For example, from forms you complete or emails you send us.
- Indirectly from you. For example, from observing your actions on our Sites. This information is collectively referred to herein as “Usage Information.” If you no longer wish for us and/or our Information Services providers to collect and use location information, you may disable the location features on your devices. You may consult each device manufacturer’s settings for instructions. Please note if you disable such features, your ability to access certain features, Information Services, content, promotions may be limited or disabled.
- Internet or other similar network activity. We may collect your Internet Protocol address, browsing history, device type, and IP address(es), referring and exit web pages and URLs, and certain other device data, including the time of day you visit our Sites.
Other information is collected from you automatically when you navigate through the Sites. We collect this information to provide customized Information Services, content, and other information that we think may be of interest to you.

- Use of Cookies and other Tracking Technologies
We may also use various methods and technologies to store or collect Usage Information (“Tracking Technologies”). Tracking Technologies may set, change, alter and/or modify settings or configurations on your device(s). A few of the Tracking Technologies used on our Sites, include, but are not limited to, the following (as well as future-developed tracking technologies and/or methods that are not listed here):
- Cookies. A cookie is a file placed on a device to uniquely identify your browser or to store information on your device. Our Sites may use HTTP cookies, HTML5 cookies, Flash cookies and other types of cookie technology to store information on local storage.
- Web Beacons. A web beacon is a small tag (which may be invisible to you) that may be placed on our Sites’ pages and messages.
- Embedded Scripts. An embedded script is programming code that is designed to collect information about your interactions with the Sites, such as the links you click on.
- ETag, or entity tag. An ETag or entity tag is a feature of the cache in browsers. It is an opaque identifier assigned by a web server to a specific version of a resource found at a URL.
- Browser Fingerprinting. Collection and analysis of information from your device, such as, without limitation, your operating system, plug-ins, system fonts and other data, which is collected for purposes of identification.
- Recognition Technologies. Technologies, including application of statistical probability to data sets, which attempt to recognize or make assumptions about users and devices (e.g., that a user of multiple devices is the same user).
We may use Tracking Technologies for a variety of purposes, including: (i) to allow you to use and access the Sites, including for the prevention of fraudulent activity and improved security functionality; (ii) to assess the performance of the Sites, including as part of our analytic practices or otherwise to improve the content, products or Information Services offered through the Sites; (iii) to offer you enhanced functionality when accessing the Sites, including identifying you when you sign into any of our Sites, keeping track of your specified preferences and/or to track your online activities over time and across third-party sites; and/or (iv) to deliver content relevant to your interests on our Sites and third-party sites based on how you interact with our content.

- Do Not Track Signals (“DNT”). Some web browsers have a setting which requests that a web application disable its tracking of an individual user. When you choose to turn on the DNT setting in your browser, your browser sends a special signal to websites, analytics companies, ad networks, plug in providers, and other web services you encounter while browsing to stop tracking your activity. Various third parties are developing or have developed signals or other mechanisms for the expression of consumer choice regarding the collection of information about an individual consumer’s online activities over time and across third-party websites or other online services (e.g., browser do not track signals), but there is no universally-agreed upon standard for what a company should do when it detects a DNT signal. Currently, we do not monitor or take any action with respect to these signals or other mechanisms. - HOW WE USE YOUR INFORMATION
We may use your information for various business purposes, including:
- Responding to your request for information;
- Providing Business Services to you, including legal services provided by way of referrals to licensed lawyers;
- Verifying your identity and for fraud prevention;
- Providing you with updates and information about the Business Services we provide;
- Sending you marketing information about BPI and our Affiliates;
- Sending you email communications such as electronic newsletters about our Business Services and events and promotions which may be of interest to you, but only with your permission;
- Improving the effectiveness of our Sites, our marketing endeavors, and services offerings, including testing and creating new services;
- Identifying your service preferences, providing personalized content and ads, and informing you of new or additional information, and Business Services that may be of interest to you;
- Protecting the security and integrity of the Sites, including understanding and resolving any technical and/or security issues reported on our Sites;
- Engaging in analysis, research, and reports regarding the use of our Sites and Business Services;
- For internal business purposes;
- Complying with the law and protecting the safety, rights, property and/or the security of BPI, our Business Services, and the general public; and
- For other purposes disclosed at the time you provide your information or as otherwise set forth in this Privacy Policy.
- WHEN WE DISCLOSE YOUR INFORMATION
We may aggregate, deidentify, and/or anonymize any information collected through the Sites or Business Services to the extent that such information is no longer linked to your personally identifiable information. We may use and share this aggregated and anonymized information (which qualifies as non-personal information) for any purpose, including without limitation, for research, development, and marketing purposes, and may also share such data with our Affiliates and third party business partners.
We do not disclose or sell personal information to anyone unless you specifically approve such disclosure in writing. However, we may disclose your personal information to third parties in limited circumstances such as (i) to comply with our legal and regulatory obligations, (ii) to make or defend legal claims, (iii) to protect against the fraudulent activity of the account holder and/or others, (iv) to enforce our Terms of Use and this Privacy Policy, along with any other contract(s) you enter into with us, (v) for internal operations (including, but not limited to, research, statistics, review of our company’s practices under the authorization of a state or national licensing board or standards setting organization, or as necessary to properly respond to an inquiry or complaint from such a licensing board or organization or standards setting organization); and (vi) to disclose as we believe to be reasonably necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to protect our operations and/or those of any of our Affiliates; (c) to protect our rights, privacy, safety and/or property, and/or that of our Affiliates,, users and/or others; and/or (d) to allow us to pursue available remedies or limit the damages we may sustain; (iv) in conjunction with a prospective purchase, sale, or merger of all or part of our company, provided that we take appropriate precautions (for example, through a written confidentiality agreement) so the prospective purchaser or merger partner does not disclose information obtained in the course of the proposed transaction; (vii) to provide information to Affiliates and nonaffiliated third parties who perform services or functions for us in conjunction with our Business Services to you, but only if we have a contractual agreement with the third party which prohibits them from disclosing or using any personal information obtained from us other than for the purposes for which the data was disclosed. Examples of such disclosures include using a payment processor, reservations maker, merchandise store, customer service provider and email marketing provider.
- DATA RETENTION
We will retain your information for so long as we need the personal and/or sensitive information for the purposes it was collected, including for the purposes of satisfying any legal, accounting, or reporting requirements, unless a longer retention period is required under applicable law or regulation, or as requested by you. If you wish to request that we no longer use your personal information to provide you with our Business Services, you may contact us as specified in Section 15 below.
To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements. Our minimum retention period is seven (7) years for all financial records. For emails and other written communications, our minimum record retention period is one (1) year. For all other purposes, our minimum record retention period is three (3) years. In all cases, the date of retention is measured starting from your last access to our Sites or the last use of our Business Services.
When you request that we delete data, we follow a deletion policy seeking to make sure that your data is safely and completely removed from our servers or retained only in anonymized form. However, please note even after you have stopped using our Business Services, we may continue to store your personal data if doing so is necessary for us to fulfil our legal obligations. We may be required to keep your information for as long as necessary, see Data that we retain for longer periods of time when necessary (see below) for more details.
There are two (2) types of data for these purposes: (1) automatically deleted data and (2) data that we retain for longer periods of time when warranted.
Automatically deleted data. Some data expires after a specific period of time. For each of this type of data, we set retention timeframes based on the reason for the data collection.
Data that we retain for longer periods of time when necessary. We may be required to keep your information for as long as necessary (i) to comply with our legal and regulatory obligations,(ii) to make or defend legal claims, (iii) to protect against the fraudulent activity of users and others, (iv) to enforce our Terms and Conditions and this Privacy Policy and any other contract(s) you have entered into with us, (v) to administer our Sites and keep them safe and secure, and for internal operations (including, but not limited to, research, statistics, troubleshooting, data analysis, testing, survey and similar purposes); and (vi) to disclose as we believe to be necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to protect our operations and those of our Affiliates; (c) to protect our rights, privacy, safety and property, and that of our Affiliates, users and others; and/or (d) to allow us to pursue available remedies or limit the damages that we may sustain.
Some of the reasons we may retain your data following a request to delete are listed below (not an exhaustive list):
- Complete the transaction for which we collected the personal information, provide the Business Services that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or agreement conducted in accordance with federal or state law, or otherwise perform our contract with you.
- Detect security incidents, protect against malicious, deceptive, fraudulent, and/or illegal activity, and/or prosecute those responsible for such activities.
- Debug products to identify and repair errors that impair existing intended functionality.
- Exercise free speech, ensure the right of another consumer to exercise their free speech rights, and/or exercise another right provided by law.
- Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
- Comply with the law, a court order and any other legal obligation(s).
- Make other internal and lawful uses of the information which are compatible with the context in which you provided the personal data.
- We will delete or deidentify personal information not subject to one of these exceptions from our records and will direct our service providers to take similar action.
- CHILDREN’S PRIVACY
The Sites are not intended for use by children under the age of 18. We do not request, or knowingly collect, any personally identifiable information from children under the age of 18. If you are the parent or guardian of a child under 18 who you believe has provided their information to us, please contact us at [email protected] to request the deletion of that information.
- VISITORS TO OUR SITES OUTSIDE OF THE UNITED STATES
If you are visiting our Sites from a location outside of the U.S., your information may be transferred to, stored and/or processed in the United States in accordance with this Privacy Policy and applicable with the laws of the United States and various U.S. state laws and any related federal or state regulations. Please note that data protection and other applicable laws of the United States and the individual U.S. states may differ from those of the country in which you live, and your information may be subject to access requests from governments, courts, and/or law enforcement in the U.S. according to the laws of the United States and its individual states. By using the Sites or providing us with your personal information, you consent to the transfer of your information to us as set forth in this Section 6 and this Privacy Policy generally.
- SECURITY
We incorporate commercially reasonable safeguards to help protect and secure your personal information, including encryption of your personal data. However, no data transmission over the Internet, mobile networks, wireless transmission, and/or electronic storage of information can be guaranteed to be 100% secure. As a result, we cannot guarantee or warrant the security of any information you transmit to or from our Sites, and you provide us with your information at your own risk. You must take whatever security measures on your devices and systems as you deem appropriate and necessary.
- INTERNATIONAL DATA TRANSFERS
Because we work with global companies and technologies, we may transfer your personal information outside of the country from which it was originally transmitted. This may include transfers to third parties, such as service providers or affiliated entities who are located outside the United States or the European Union, where data protection laws may not offer the same level of protection as those in the U.S., the European Economic Area, the United Kingdom and/or Switzerland. When we transfer personal data to any areas outside the U.S., we take steps to make sure the recipient has appropriate safeguards in place to protect your personal and sensitive information.
- YOUR RIGHTS AND CHOICES
There are a number of U.S. states which have privacy laws. While the laws in each state differ somewhat, they have certain common provisions. This section describes your rights and explains how to exercise those rights under the relevant common provisions.

- Right To Know What Information We Collect, With Whom We Share Your Information, And The Right To Data Portability – You may request that we disclose to you the categories of personal information we collect about you, the categories of sources from which we collected that personal information, the categories of personal information we disclosed, our business or commercial purposes for collecting such personal information, the categories of third parties to with whom we shared such personal information, and the specific pieces of personal information we collected about you over the past 12 months. Any requests made more frequently are not accepted or will be subject to a charge for the reasonable cost of the services you are requesting.
- Right To Request Deletion Of Your Information – You may request we delete some or all of the personal information we maintain about you, subject to certain exceptions. If we cannot delete your personal information, we will give you a reason why we cannot do so. For security reasons, you or your authorized agent may be asked to verify your/their identity. Note that some personal data may be retained as permitted by law (e.g. to comply with legal obligations, to prevent fraud, etc.).
- Opt-out of “Sale”/ “Sharing” of your personal information ––We do not currently consider the ways we shared personal information in the past 12 months to comprise the “sale” of personal information as defined in the various state privacy laws. For purposes of this Privacy Policy, “sell” means the sale of your personal information to a third party for monetary or other valuable consideration, subject to certain exceptions in the various state’s privacy laws.
- Right to Correct Inaccurate Personal Information. Taking into account the nature of the personal information and the purposes of the processing, this right provides an individual with the ability to seek to correct or update any personal data that individual considers incorrect which we hold about them.
- [Right to Limit Use of Sensitive Information. This right is limited to sensitive personal information used for the purpose of inferring characteristics about an individual. We do not collect sensitive personal information, nor do we use sensitive personal information for the purpose of inferring characteristics about an individual, therefore we do not offer a path to exercise this right.
- Right of Non-Discrimination and Non-Retaliation. This right prohibits (a) denying an individual access to or use of our Business Services, (b) charging different prices or rates for those Business Services, and/or (c) providing a different level or quality for those Business Services, as a result of the individual exercising any right under any data protection and privacy laws and/or regulations. We will not discriminate against you because you made any of the requests listed in this Section 9. We will not: (i) deny you our Business Services; (ii) charge you different prices or rates for those goods Business Services, including through granting discounts or other benefits, or imposing penalties; (iii) provide you a different level or quality of our Business Services, or (iv) suggest that you may receive a different price or rate for our Business Services or a different level or quality for our Business Services. However, we may offer you certain financial incentives that may result in different prices, rates, or quality levels. Any permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.

- Right to Appeal. This right provides an individual with the opportunity to appeal any decision or lack of decision on our part related to the exercise of any right the consumer is granted under the applicable state law. To submit an appeal, please contact us as provided in Section 15 and make sure to include the specifics of your claim.
- Right to Access. You have the right to confirm whether or not we are processing your personal information and access such personal information. Please note this right might be subject to certain limitations. For instance, at least one state provides that companies are not required to personal or sensitive information if such confirmation or access would require the company to reveal a trade secret. Trade secrets, of course, continue as a valid basis on which to decline to provide a response, but how a trade secret is defined is generally governed by state law.

If you are a resident of Nevada, you also have the right to request that a company not sell your personal data for monetary consideration to certain other parties. We do not sell your personal information. If you would like to exercise any of these rights (including the right to appeal), please contact us as provided in Section 15.

- Personal Information Sales Opt-Out and Opt-In Rights

You have the right to direct us to not sell your personal information at any time (the “right to opt-out”). We do not sell the personal information of any consumers, regardless of age.
- Unsubscribe Preferences
We may use your email address to confirm your request, to send you information about changes to our Business Services, and to send notices and other disclosures as required by law. Users may opt-out of all email communications from us by contacting us at [email protected], as otherwise provided in Section 15, or clicking the button on the relevant email, page or text. We will process your unsubscribe request within the required legal timeframes, but please be aware that in some circumstances you may receive a few more messages until your request is processed. You also may opt-out of receiving such emails or texts by clicking on the “unsubscribe” link within the text of the applicable email.
You may contact us to request information about the personal information we have collected from you and to request the correction, modification or deletion of such personal information as provided in Section 15.
- Denial of or Partial Response to Requests
We may deny certain requests, or fulfill a request only in part, based on our legal rights and obligations. For example, we may retain personal information as permitted by law, such as for tax or other record keeping purposes, to process transactions and facilitate customer requests, and/or to protect against fraud and other misuse of our Sites. We will take reasonable steps to verify your identity (or that of anyone acting on your behalf) prior to responding to certain of your requests. The verification steps will vary depending on the sensitivity of the personal information. In some locations, you may designate an authorized agent to make a request on your behalf. When submitting such a request, please ensure you have adequately identified and authorized anyone acting on your behalf.
- Marketing Materials
If you do not wish to receive marketing materials by regular mail or email from us, please contact us in accord with Section 15, or check the relevant box in any email or on the Ss.
- Your Request Must:
- Provide sufficient information for us to reasonably verify that you are the person about whom we collected the personal information or an authorized representative of such person; and
- Describe your request with sufficient detail for us to properly understand, evaluate, and respond to it.
We cannot respond to your request if we cannot verify your identity or authority to make the request and confirm that the requested personal information relates to you or the person on whose behalf you claim to act. In order to verify your identity, we will generally require the matching of sufficient information you provide us to the information we maintain about you in our systems. Please provide your name, the email address in the original request, as well as an explanation of the right(s) you wish to exercise. We will use the information provided in a request solely to verify your identity or authority to make the request and to review and comply with the request. If you do not provide this information, we may not be able in all circumstances to verify or complete your request.
If you wish to submit a verifiable consumer request on behalf of another individual, we will also need sufficient information to verify the individual on whose behalf you seek to exercise rights is the person about whom we collected personal information and that you are authorized to submit the request on their behalf. For requests to know, access, correct or delete personal information, we may ask you to provide sufficient evidence to show that you have provided the authorized agent signed permission to act on your behalf, verified your own identity directly with us pursuant to the instructions set forth in this Privacy Policy, and directly confirmed with us you provided the authorized agent permission to submit the request on your behalf.
- Response Timing and Format.
We will confirm receipt of your request to know, correct, delete and/or seek any request under the relevant U.S. state privacy laws and regulations within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact us at [email protected]. We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of receipt. If we require more time (up to another 45 days), we will timely inform you of the reason(s) and extension period in writing.
Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. Any requests made more frequently are not accepted or will be subject to a charge for the reasonable cost of the Business Services you request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format in which to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
- Shine the Light.
